2. If the download said "free to non-profits, all others pay $x" and you are not doing a non-profit project, then, if you use the clip in something you will get paid for, you probably owe the money.
3. I would suggest that you make the use a "non-profit project". You agree, in writing, with the radio station, before the thing is aired, that any monies received will go to a recognized charity. (The Red Cross for Haiti? The local Boys & Girls Club?) This would probably retroactively make it a "non-profit project". If/when the song gets picked up for wider distribution, make the same arrangement.
